$130,000 Compensation for slip & fall in Blacktown retail store

Our 49-year old client was doing some Christmas shopping with her sister in a large retail store at Blacktown when she slipped on gel on the floor and fell forward and landed on both her knees.

Slip & Fall Accident Medical issues

Following her slip and fall she saw her GP who initially thought she would recover within a few weeks. She was told to rest and come back to see the GP if she had any further problems.

Our client struggled through the Christmas break and then returned to her GP early in the new year at which time he arranged for an ultrasound scan which showed she had full thickness tears and tendon damage in both her knees.

Both knees were still swollen and her GP recommended she have physiotherapy which she says did not help much and, in fact, made her knees feel worse.

Her GP then sent her to see an Orthopaedic Surgeon who also recommended she have conservative treatment which included physiotherapy.

Our client continued to suffer from pain and the Orthopaedic Surgeon ultimately carried out an arthroscopy on both knees, on separate occasions.

Whilst she has difficulties going up and down ladders, our client’s symptoms largely resolved in both knees.

Court proceedings

We commenced Court proceedings against the large retail store and claimed negligence for failing to remove the water from the floor, failing to place a mat over the spillage or to erect warning signs nearby.

We claimed past out of pocket expenses for the extensive physiotherapy our client required following both surgeries and for ongoing future treatment from her GP and Orthopaedic Surgeon. Luckily for our client the only time she had off work was a couple of weeks during her surgeries and she was able to return to her normal duties.

The retail store denied negligence and claimed our client contributed to her own injury by failing to look after her own safety and failing to avoid the area.

Slip & Fall Compensation Settlement

The Defendant agreed to attend an Informal Settlement Conference at which time we were able to settle the claim for $130,000 compensation. Our client was very happy with the result.
