Woman settles compensation claim for $60,000 after slipping in a Supermarket

We acted for Mrs M who was shopping at an Aldi store in Fairfield when she slipped on a white cream substance which blended in with the colour of the tiles. As a result of the slip she fractured her right wrist and injured her hip.

Mrs M was not working at the time so she had no entitlements to claim loss of income however, she was entitled to claim pain and suffering, treatment expenses and care.

Mrs M approached our offices for advice after having her accident and she was advised that the Aldi store was negligent and had failed to ensure that the floor was cleaned and or it failed to ensure that it had appropriate warning signs, warning customers of the hazard on the ground.

When Mrs M’s injuries had stabilised we arranged for her to medically assessed by an independent medico-legal specialist, namely an Orthopaedic Surgeon and a Psychiatrist and an Occupational Therapist was sent out to examine her and assess her in her own home. The purposes of these reports was to ascertain the degree of impairment that Mrs M had suffered or was likely to continue to suffer in the future, Mrs M’s need for ongoing treatment and the cost of the same and Mrs M’s need for domestic care and assistance around the home as a result of this accident.

Proceedings were commenced in the District Court of New South Wales and once the medical evidence had been obtained an invitation had been extended to the solicitors for the insurance company inviting them to participate in a settlement conference. Solicitors for the insurance company agreed to participate in a settlement conference and after exhausting settlement negotiations indicated that they were prepared to offer Mrs M the sum of $60,000.00 in respect of her injuries.

Mrs M had numerous pre-existing conditions and injuries which worked against her and therefore the sum of $60,000.00 represented an excellent settlement in the circumstances and Mrs M was advised to accept the offer which she ultimately did.
