Injured passenger receives $400,000 in compensation after driver lost control of car
Published 09 Apr 2015
We acted for Mr S who was a passenger in the motor vehicle being driven by a friend along the Princess Highway in the vicinity of Hawkesbury River. The driver lost control as he attempted to negotiate a bend, resulting in the vehicle spinning around and ultimately colliding into a tree. As a result of the impact, Mr S was ejected out of the vehicle and sustained serious injuries, including an injury to the neck, fractured ribs, fractured sternum and scarring.
Mr S was initially self-represented and was dealing with the insurance company on his own. He was advised by a friend to seek legal advice and was referred to our firm by a family friend.
We saw Mr M in conference and he was advised that he had a very large case which should be vigorously pursued. Mr S Instructed our firm because we were specialists in this area of compensation and he felt confident that he could intrust his matter to our offices knowing that the matter would be handled by an Accredited Personal Injury Specialist who specialised in motor accident compensation.
Arrangements were made to have Mr S assessed by various medico-legal practitioners, including an Orthopaedic Surgeon, Psychiatrist, Plastic Surgeon an Occupational Physician and an Occupational Therapist. The purposes of these reports were to determine a number of things including the nature of Mr S’s injuries, the level of impairment, his need for future treatment, the effects of the accident on his ability to return to employment, and the effects of the accident on his capacity to perform his household chores.
The reports received were supportive and offers were conveyed to the insurance company and they were invited to participate in an informal settlement conference.
After lengthy negotiations and discussions the insurance company had offered the sum of $400,000.00 to resolve the matter in order to move on with his life which had been dramatically altered as a result of the car accident.
Mr S was very pleased with the result noting that he had managed to resolve the matter in twenty-four (24) months after the accident.
