Passenger in motor vehicle accident resolves whiplash claim for $50,000

Mrs E was a rear seat passenger in a vehicle being driven by her father. As her father attempted to exit the M7 motorway in the vicinity of Hoxton Park he entered the intersection and another vehicle failed to stop and collided into his vehicle. As a result of the collision Mrs E sustained injuries to her neck including a Whiplash injury and injuries to her shoulder.

Police and ambulance were called and Mrs E was conveyed to Westmead Hospital where she was treated and discharged that same day.

Mrs E was not working at the time because she was on a disability support pension and therefore there was no claim for non-economic loss.

This is an approach that offers to assist her with the claim. Our office acted promptly by serving a Personal Injury Claim Form onto the insurer and arranging for Mrs E consult with various medico-legal specialists. Upon receipt of those reports a settlement conference was arranged at the Defendant’s offices and the matter resolved in a sum of $50,000.00.

Mrs E was thrilled with the result that was achieved particularly as she had not suffered any economic loss as a result of her injuries. Furthermore her injuries were assessed as being less than10% Whole Person Impairment which meant that she was not entitled to non-economic loss. That being the case the settlement of $50,000.00 represented an excellent result in the circumstances Mrs E was pleased with the outcome. The matter was resolved within 12 months and therefore we were able to keep legal costs to a minimum.
