Asbestos Related Illness Claims
Published 01 Jun 2011
Can I claim compensation if I am diagnosed with an asbestos related disease? Can I claim Government benefits as well as making a claim?
If you have been diagnosed with an asbestos related disease than you will be able to make a claim for compensation.
If you were exposed to asbestos in the workplace then you will be entitled to compensation under The Workers Compensation (Dust Diseases) Act. This Act authorises the Dust Diseases Board to provide compensation to people who have developed a dust disease, including an asbestos related disease, through occupational exposure as a worker in New South Wales.
If your exposure did not happen in the workplace, you may be entitled to make a claim for personal injury compensation to the New South Wales Dust Diseases Tribunal. The Tribunal handles compensation claims for people who have been exposed to asbestos and other dusts as a result of another’s negligence.
At Gerard Malouf & Partners we can assist you in determining where your exposure occurred, so that you can make your claim for compensation in the right place. Our expert personal injury compensation lawyers, understand the nature of these diseases and that symptoms in relation to asbestos exposure may manifest as late as twenty years after the initial exposure.
The compensation for asbestos related diseases includes lump sum compensation payments, weekly benefits and payment of your medical expenses.
Your family is also protected under the dust diseases compensation schemes. The Workers Compensation (Dust Diseases) Bill was passed in 2010 and has increased the maximum lump sum payment,s to families of workers who die as a result of asbestos exposure to $311,050 over three years in addition to weekly payments for dependent family members.
You may also be entitled to claim Government benefits including Centrelink payments, Veteran Affair payments and other pensions. Your entitlement to receive these pensions will depend on the amount of compensation benefit you receive.
